When is an SPCC Plan required for farms that store oil products?
In 2013, the SPCC regulations were amended to direct farms that had above ground oil products storage capacities of 1,320 gallons or more must develop and implement a Spill Prevention, Control and Countermeasure (SPCC) plan in accordance with 40 CFR Part 112.
SPCC compliance required approved secondary containment to be in place to prevent any oil spillage sheen from reaching waterways, either by near-by storm drains, ditches, streams, rivers, or canals, etc. The compliance resulted in excessive costs levied on the farmers when the risks of most farms’ oil spill reaching navigable waters was negligible.
Fortunately, in 2014 the Water Resources Reform and Development Act was signed into law. The Act amended certain applicability provisions of the SPCC rule for farm facilities and modified the criteria under which a farmer could self-certify a plan.
This act has been amended directing farms that have an aggregate oil storage capacity of 2,500 gallons or less than 6,000 gallons with no spill history are no longer subject to SPCC plan requirements. Those facilities with oil product storage capacities in excess of 20,000 gallons or with a single vessel over 10,00 gallons must have a Professional Engineer Certified SPCC Plan. Those with storage capacities less than 20,000 gallons and more than 6,000 gallons must adapt a self-certified Tier I or Tier II SPCC Plan.
SPCC Regulations
A properly compliant SPCC plan will cover all applicable regulations including a detailed discussion of the following:
- A explanation of all oil product vessels of 55 gallons or more.
- Secondary containment description and calculations. This containment may be in the form of passive such as double walled vessels, constructed walls capable of holding the quantity of the largest vessel plus 10% if outdoors until cleanup and disposal can be accomplished.
- Storage tank integrity test compliance directives
- Topographical Maps showing distance to any waterways, bodies of water or intermittent streams
- Diagram of facility detailing the location of all oil product storage vessels and the primary direction of drainage from the facility
- Specific reference to all applicable EPA regulations
- An Oil Spill Contingency Plan detailing all actions to be taken in the event of a major oil spill
- Employee training directives and applicable records
- Oil storage vessel inspection directives and forms
- Unloading of oil products procedures and precautions
- Gasoline, diesel, hydraulic oil, Crop oil
